The Rules That Keep Irish Roads Safe & What They Mean
When it comes to commercial vehicle testing and roadworthiness in Ireland, it’s important to know that there’s a far-reaching legal framework behind it. Developed and updated over a number of years, the standards set down are clear and enforceable and when you’re driving commercially, you need to follow them.
The foundation that everything is built on is the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012. It established the legal basis for commercial vehicle CVRT testing in Ireland, as well as the obligations drivers and fleet managers have in keeping their trucks and vans up to spec.
Since then, a series of updates have added further detail, updating and expanding the rules, and it pays to be fully up to speed with what’s required.
What the Regulations Cover
The commercial vehicle test is the visible part - the thing people book, turn up for, and think about once a year. But the legislation that sits behind it deals with how vehicles are managed day to day, who is qualified to work on them, and what paperwork needs to be in place to show that obligations are being met.
For operators, that's a much broader set of responsibilities than just making sure the vehicle passes its test. They include:
Maintenance and repairs - They have to be carried out by someone with the right qualifications and experience. You can't hand the job to whoever's available, as the law specifies that the person doing the work needs to be properly trained to do it.
Daily walk-around checks - These are a legal requirement before any vehicle goes out on a public road. The driver doing the check needs to be trained to carry it out properly, and any defects found have to be reported to the vehicle owner straight away.
Record keeping - Operators are required to keep documentation showing that vehicles are being maintained as they should be, and an annual declaration has to be submitted to the RSA confirming that maintenance obligations are being met.
Taken together, these regulations make clear that the legal obligation on operators runs continuously, and not just on the day of the test.
